Inoltre per i profili penali della vicenda occorre valutare la possibile costituzione di parte civile contro i responsabili del disastro.  Per i casi di morte o lesioni personali, la legge italiana può realmente prevedere un rimedio più accurato che la US General Maritime Law e la legge statutaria, governati da una legge federale per gli Stati Uniti, chiamata Death on the High Seas Act (“DOHSA”). Non vi è alcun recupero ai sensi della DOSHA per la pre-morte, dolore e sofferenza o perdite emotive dei familiari sopravvissuti, come dolore e lutto, ma solo per le perdite finanziarie: così se i casi di omissione di soccorso penali saranno depositate negli Stati Uniti, e il Giudice applicasse la legge degli Stati Uniti, potrebbero andar perdute importanti voci di alcuni danni. Eppure, anche se il biglietto emesso prevede la applicazione del diritto del Regno Unito o un diritto straniero, e le querele sono depositate in Italia, ci sarebbe il recupero di diritto italiano. Un passeggero, concettualmente, potrebbe sporgere denuncia in un foro giudiziario per lui più conveniente, come nel Regno Unito o negli Stati Uniti, ma per questo non ricevere alcun risarcimento in alcuni casi, mentre se il passeggero avesse presentato una denuncia in una posizione forse meno conveniente come in Italia, ci potrebbero essere maggiori riconoscimenti economici.

    Poi c’è la questione della class action avviata Miami a Carnival inc., la società madre di Costa, presentata dagli avvocati dello studio Proner & Proner. Il collegamento tra la Carnival e le società Costa Crociere, non significa automaticamente dare a chiunque il diritto di citare in giudizio in Miami la società madre ogni volta che una delle navi da crociera delle società controllate in tutto il mondo causano danni od una vittima. Ci saranno gravi conseguenze in caso di archiviazione per aver agito in luogo errato o contro la società sbagliata, compresa la valutazione dei costi e di spese legali a carico dei clienti.FATE ATTENZIONE, inoltre, perché alcuni grandi studi legali in tutto il mondo stanno facendo molta pubblicità sulla vicenda, passando poi semplicemente i clienti alle associazioni dei consumatori italiane, collegate con avvocati e studi legali italiani, cercando di raccogliere abbastanza persone per far partire la class action a Miami per il naufragio Concordia.     me & my wife & kids were on the Concordia from Sweden, and we agree that we won’t apply for the class action, could you send us some more info’s? we gave on the departure site a blank check for 2.000,00 euro as account for the expences onboard, what will happend now?

Call Your bank and stop the payment for your check, you can declare it as a lost check on the shipwreck. As for now we think that all the cruise payment still on hold(credit cards and checks) will not be filed

    We talked with the biggest NY law firm, which is filing a class action and will ask 150,000 USD for each person onboard, is that really the amount they are asking in Italy too?

      Our initial line of claim is NOT to ask for a certain amount, since we are not obliged to do so in the registered letter.

      Please read our detailed article about the vantage of the single action compared to the class action; the general settlement reached in the class action will be the base for our claim, since we will proceed to get further and more detailed damage compensations referred to the single case. The general amount will come from the settlement with Lloyd’s of London, or by the base offer from Costa Crociere, but we are very far from knowing if it will be 10.000,00 or 150.000,00 for each one of the passengers, so You should not trust big numbers for now, they just try to get your case, but they cannot predict the base damage compensation for now.

      Please consider also that some big firm is just passing clients to an Italian consumers’ association, connected with lawyers, trying to collect some enough people to file the class action in Miami for the Concordia shipwreck.
